Publicly funded lawyers play an important role in protecting defendants who cannot afford private legal representation. In many countries and regions, these attorneys are assigned to represent people facing criminal charges so that lack of money does not prevent access to legal assistance. However, public defenders often handle many cases at the same time. When workloads become too heavy, lawyers may have limited time to investigate evidence, interview witnesses, study legal issues, or meet privately with each client before important hearings and trials.

Excessive caseloads can affect the quality of legal representation. A lawyer who is responsible for too many defendants may have difficulty identifying weaknesses in the prosecution's case or preparing arguments that reflect an individual client's circumstances. Defendants may also receive less explanation about possible pleas, trial strategies, or the consequences of different legal choices. If preparation is rushed, mistakes are more likely and important evidence may be overlooked. This can weaken confidence in the justice system and raise concerns about whether people who depend on public defense receive the same opportunity for a fair outcome as those who can hire private attorneys.

One response is to set limits on the number of cases each public defender may handle and increase funding for legal-aid programs so that more lawyers can be hired. Lower caseloads could give attorneys more time to prepare each case and communicate with clients. However, these reforms can be expensive because governments must pay salaries and support costs for additional staff. The problem may be even harder to solve in rural or remote areas, where relatively few qualified lawyers are available. Even if budgets rise, authorities may still struggle to recruit enough experienced professionals. As a result, improving public defense requires not only more funding but also a sufficient supply of trained legal specialists.
